Industry submits complaint on French law banning BPA from food contact materials

PC/BPA Group submits complaint on French law banning BPA from food contact materials
On 26 March 2013, the PC/BPA Group of PlasticsEurope submitted a complaint to the European
Commission following the adoption by France of law n°2012-1442 in December 2012 banning the use
of BPA in food contact materials.
Industry considers that the French law infringes on numerous EU provisions, including:
o The principle of the free movement of goods
o Regulation 1935/2004 on food contact materials and Commission Regulation 10/2011 on
plastic materials and articles intended to come into contact with food
o Commission Regulation 1895/2005 on epoxy derivatives in food contact materials
o The precautionary principle
o The Technical Standards Directive 98/34
o WTO law
The PC/BPA Group of PlasticsEurope asks that the Commission take the necessary steps to stop these
infringements.
